A professional employer organization (PEO) takes on co-employment: it becomes the employer of record for payroll tax and insurance purposes, and bundles benefits, workers' compensation, and HR support into one fee. A payroll service does one job — pay people accurately and file the taxes — under your own FEIN, while you keep your carriers, your broker, and your HR.

The right answer depends on headcount, how your own medical renewal prices, how hard your workers' comp is to place, and how much cost visibility you want. Below is the comparison, the fit test, and what a move costs in California specifically.

What California adds to the decision

Daily overtime

California pays overtime after 8 hours in a day and double time after 12 — not just after 40 in a week. Whichever model you pick, the payroll engine has to get this right every run.

Meal and rest premiums

Missed breaks trigger premium pay at the regular rate of pay. That liability sits with the worksite employer, PEO or not.

Local minimum wages

Dozens of California cities and counties set their own minimum wage, often on a July cycle. Multi-location employers need wage rules by work location, not by company default.

Mid-year moves matter too: leaving a PEO changes your FEIN of record for wages, which resets SUI and Social Security wage bases and disrupts the benefit plan year. January 1 is usually the cleanest date.
